1. Acceptance of Terms

Welcome to the Retirement Calculator ("Service") provided by SuperSavvy ("we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of the Service. By accessing or using the Service, you agree to these Terms. If you do not agree to these Terms, you must immediately cease all use of the Service.

2. Nature of the Service & Disclaimer of Advice

2.1. For Educational and Illustrative Purposes Only

The Service is a software tool designed to provide generalised, hypothetical estimates based on the data you provide and pre-programmed assumptions. All calculations, figures, and results generated by the Service are for informational and illustrative purposes only and should not be considered a statement of fact or a guarantee of any outcome.

2.2. Not Financial or Professional Advice

The Service and any information it provides do not constitute financial, investment, credit, legal, taxation, or any other form of professional advice. The Service does not take into account your personal objectives, financial situation, or specific needs.

2.3. No Guarantee of Accuracy

While we strive for accuracy, we make no representation, warranty, or guarantee as to the reliability, accuracy, or completeness of the information or calculations provided. The results are entirely dependent on the data you input and the underlying assumptions of the model, which may not apply to your individual circumstances.

2.4. Requirement to Seek Independent Advice

You must not act, or refrain from acting, on the basis of any information or calculation generated by this Service. Before making any financial or other decision, you are required to seek independent, professional advice from a qualified and licensed professional (such as a financial planner, accountant, mortgage broker, or lawyer) who can conduct a full assessment of your personal situation.

3. Third-Party Referrals

3.1. Facilitation of Introduction

The primary purpose of this Service may include generating leads for third-party professionals. Should you express interest, you may be given the option to request an introduction to one or more of our third-party partners ("Third-Party Partners").

3.2. No Endorsement or Guarantee

Our facilitation of an introduction to a Third-Party Partner does not constitute an endorsement, approval, warranty, or guarantee of their services, advice, conduct, or qualifications. We are not an agent for any Third-Party Partner, and we do not vet the specific advice they provide.

3.3. Separate and Direct Relationship

Your relationship, and any subsequent communication, agreement, or transaction with a Third-Party Partner, is strictly and solely between you and that third party. We are not a party to that relationship and will not be involved in any disputes that may arise. You are responsible for conducting your own due diligence before engaging their services.

3.4. Disclaimer of Liability for Third Parties

To the fullest extent permitted by law, we expressly disclaim all liability for any advice, actions, omissions, damages, or losses of any kind you may incur as a result of your engagement with any Third-Party Partner. Any claim or dispute you may have must be directed solely to the relevant Third-Party Partner.

3.5. Referral Fee Disclosure

You acknowledge and agree that we may receive a referral fee, commission, or other benefit from a Third-Party Partner for facilitating an introduction.

4. User Responsibilities

4.1. Accurate Information

You are solely responsible for the accuracy and completeness of the information you input into the Service.

4.2. Lawful Use

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the Service by any third party.

5. Limitation of Liability

To the maximum extent permitted by law, SuperSavvy, its directors, employees, affiliates, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, revenue, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to, use of, or inability to access or use the Service;
  • Any errors, inaccuracies, omissions, or outdated information in the calculations or content provided by the Service;
  • Any decision made, action taken, or failure to act in reliance on the information generated by the Service; or
  • Any conduct, advice, service, or omission of any Third-Party Partner referred to you through the Service.

5.2.

This limitation of liability shall apply whether the alleged liability is based on warranty, contract, tort (including negligence), statute, or any other legal theory, even if we have been advised of the possibility of such damage.

6. Australian Consumer Law

For users in Australia, the provisions of the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (ACL), may confer certain rights and remedies that cannot be excluded. Nothing in these Terms is intended to exclude or limit the application of any law, including the ACL, where to do so would contravene that statute or cause any part of these Terms to be void.

7. Intellectual Property

The Service and its original content (excluding data provided by you), features, and functionality are and will remain the exclusive property of SuperSavvy and its licensors, protected by copyright, trademark, and other intellectual property laws.

8. Privacy

Our collection and use of personal information in connection with your access to and use of the Service is described in our Privacy Policy. Our Privacy Policy is incorporated by reference into these Terms.

9. Modification and Termination of Service

We reserve the right to modify, suspend, or discontinue, temporarily or permanently, the Service or any part of it with or without notice at any time. You agree that we shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service. We may update or modify these Terms from time to time. We will notify you of changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes your acceptance of the new Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Queensland, Australia. You irrevocably and unconditionally agree to submit to the exclusive jurisdiction of the courts of Queensland and any courts which may hear appeals from those courts.

11. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SuperSavvy regarding the use of the Service. This agreement supersedes all prior or contemporaneous communications, representations, or advertising claims, whether electronic, oral, or written, between you and us with respect to the Service.
